Swedes join France and Germany in Syrian CW law suit

This week, criminal complaints on the Syrian government’s chemical weapons attacks on Khan Shaykhun and Ghouta in 2017 and 2013 was filed before the Swedish police’s specialized war crimes unit. The complaint was spearheaded by Syrian victims and civil society organizations, including Civil Rights Defenders, Syrian Center for Media and Freedom of Expression (SCM), Syrian Archive, and the Open Society Justice Initiative. The groups call on Swedish judicial authorities to open an investigation into these attacks, so that Syrian officials responsible for these war crimes can be put on trial under the principle of universal jurisdiction. Hundreds of civilians, including children, were killed in these attacks, and many more suffered serious, long-lasting injuries. 

“By filing the complaints, we want to support the victims' struggle for truth and justice,” said Hadi al Khatib, founder and director of Syrian Archive. “We hope that a Swedish investigation into these crimes will eventually result in trials and convictions of those who ordered and carried out these attacks. Sweden can and should contribute to putting an end to the current state of impunity in Syria.” Aida Samani, legal adviser at Civil Rights Defenders, added: “In the ten years since the first assaults on pro-democracy protesters in Syria, the government has strategically used chemical weapons as a tool to wear out the civilian population living in opposition-controlled areas and to suppress any resistance against the regime. It is unacceptable that those responsible for these heinous attacks are enjoying absolute impunity.”

This complaints are the third wave in a series of filings undertaken by Syrian Archive, SCM, and the Justice Initiative, following a first complaint filed in Germany in October 2020 and a second filed in France in March 2021. These complaints could allow judicial authorities in multiple jurisdictions to open investigations into chemical weapons attacks, paving the way for warrants to be issued for the Syrian officials who perpetrated them. As in the other complaints, this filing contains first-hand testimonies from victims of the attacks and hundreds of items of documentary evidence, including photos and videos. The evidence points to the use of sarin in the attacks and provides details on the Syrian officials and chains of command responsible for these attacks.

“We want the Swedish police and prosecutors to investigate the attacks with their German and French counterparts. A joint effort will increase the chances of a future European arrest warrant and efficient justice for victims,” said Mazen Darwish, general director of SCM. Steve Kostas, a lawyer at the Justice Initiative, added: “By joining their counterparts in France and Germany to jointly investigate the use of chemical weapons in Syria, Swedish authorities can demonstrate that there will be no impunity for the perpetrators of these crimes.”

The filing comes one day before the 193 member states of the Organisation for the Prohibition of Chemical Weapons (OPCW) will meet to discuss a proposal co-sponsored by 46 states to suspend Syria’s voting rights in the organization for its failure to fulfil requests to declare the weapons used in the attacks on Latamneh and disclose its chemical stocks. Eric Witte, senior policy officer at the Justice Initiative, noted that the passage of this measure “would signal that the Syrian regime’s use of chemical weapons has diplomatic consequences.” In addition, he added that "states must go beyond this to ensure that the perpetrators of these attacks are held accountable and call for a dedicated debate in the UN General Assembly, where states can make commitments for additional measures to support justice for atrocity crimes in Syria.”

Smiths Detection’s BioFlash deployed in real-world environments

Smiths Detection, the global threat detection and security technology company, announces that its BioFlash Biological Identifier has been successfully deployed in real-world environments to detect airborne COVID-19 in almost real-time.

BioFlash works by collecting and analysing air samples using sensitive, selective and rapid detection technology to identify the presence of dangerous pathogens onsite without the need to involve a laboratory.

  • In February, Smiths Detection announced test results from a study with the US Army, which verified that BioFlash could identify SARS-CoV-2 in a laboratory setting.
  • Today, the Company is confirming that the BioFlash has been used by the University of Maryland, Baltimore County (UMBC) to identify airborne SARS-CoV-2 inside their campus and prevent the spread of the virus.
  • The University of Oregon has also successfully tested the device in quarantine and isolation spaces for students who tested positive for SARS-CoV-2, further verifying the capabilities of the BioFlash in a real-world setting.

This technology can be used to inform COVID-19 mitigation strategies and provide confidence for commercial premises to reopen and stay open, especially buildings such as medical centers and schools where there is a high risk of COVID-19 exposure.

FLIR Wins DARPA Contract Worth Up to $20.5M to Develop Revolutionary New Protective Fabrics for Chem-Bio Defense

FLIR Systems, Inc. announced it has won a contract with the Defense Advanced Research Projects Agency (DARPA) to rapidly develop novel fabrics with embedded catalysts and chemistries that can fight and reduce chemical and biological threats upon contact. The revolutionary fabrics will be incorporated into protective suits and other equipment such as boots, gloves, and eye protection that can be worn by troops on the battlefield, medical experts, healthcare workers, and more. FLIR received $11.2 million in initial funding for the potential five-year effort worth up to $20.5 million, including options.

The goal of DARPA’s Personalized Protective Biosystems (PPB) program is to reduce the substantial weight and physiological burden of current Personal Protective Equipment (PPE) so soldiers and other specialists can better perform their tasks. PPB will combine novel, lightweight protective materials with new prophylactic medical technologies that mitigate chemical and biological threats at vulnerable tissue barriers, notably the eyes, skin and lungs. The complete system will enable troops and first responders to operate without the burden of carrying and wearing PPE, which can cause heat stress and reduce time spent completing the mission.

“With lives at stake, future operators wearing PPB suits will gain a major edge in staying protected from toxic chemicals and emerging biological threats such as dangerous viruses,” said Mark Stock, VP and general manager of the Sensor Systems business at FLIR. “We’re honored DARPA has chosen us to lead this extraordinary and highly innovative effort to develop first-of-its-kind protective fabrics for our nation’s warfighters, health and public safety officials.”

FLIR and its teaming partners will develop a prototype fabric material, the Integrated Soldier Protective System (ISPS), for testing by government laboratories. Work will be performed at FLIR facilities in Pittsburgh. The ISPS award consists of a two-year base period, two-year first option, and one-year final option. The result after five years will be a suite of prototype protective fabrics and garments ready for transition to a program of record with the U.S. Department of Defense.

10 + 10 Over 10: A Funding Vision for the U.S. Fight Against Biological Threats

Operation Warp Speed – the program of major U.S. government investments that drove the rapid development of multiple vaccines for the COVID-19 virus – teaches us a lesson about how to fund the fight against biological threats in the future. That lesson is about establishing a vision of significant, sustained and stable government funding to drive focused and rapid private sector-developed solutions. We propose $10 billion per year for the Department of Defense, and $10 billion per year for Health and Human Services, over 10 years, for biodefense-related programs and initiatives. Or 10 + 10 Over 10.

COVID the Harbinger – The Rising Tide of Biological Threats

As we pass the one-year anniversary of when the World Health Organization declared the COVID-19 outbreak a pandemic, we are approaching 122 million cases and almost 3 million deaths world-wide. These numbers are a grim reminder of the losses we have experienced and a testament to how poorly this pandemic was handled around the globe. 

Unfortunately, accelerated global outbreaks are just one type of biological threat that is potentially on the rise. Some experts note that the explosion of work on pathogens with pandemic and weaponization potential has increased the probability of lab accidents and geopolitical miscalculations as more actors engage in activities that teeter at the edge of biodefense and bioweapons. Further, rapid advances in the life sciences capabilities are making them easier to use and capable of doing more, complex things. These factors, along with the convergence of biology with fields like engineering, artificial intelligence, quantum computing, and additive manufacturing (i.e. 3D printing) are also increasing the capabilities of state and non-state actors. These dynamics are also creating complex, unpredictable outcomes that make predicting technology trajectories exceptionally difficult. The technological state of play thus exacerbates concerns that biological weapons may become cheaper to produce, easier to deploy, and accomplish the desired outcome with greater precision than ever before.

The Ghosts of Biodefense Funding Past – Addressing Funding Stability and Budget Cuts

The Biden Administration has communicated its commitment to addressing and responding to natural, accidental and deliberate biological threats as a top national security priority. In National Security Memorandum 1, the Administration committed to “treat epidemic and pandemic preparedness, health security, and global health as top national security priorities…to create a world that is safe and secure from biological threats.” Executive Order 13994 directed departments and agencies to address COVID-19 and future biothreats by leveraging “the best available science and data, including by building back a better public health infrastructure.” The Interim National Security Strategic Guidance emphasized  addressing “pandemics and other biological risks [which]…pose profound and, in some cases, existential dangers.”

To properly resource the Administration’s commitment to prioritizing biological threats, there are two historic funding trends it will need to address. The first is unstable funding to important biodefense programs and initiatives. A National Research Council report found that unstable and unpredictable funding negatively impacted Department of Defense (DoD) programs like the Defense-Wide Chemical and Biological Defense Program (CBDP), which supports the US Armed Forces by researching and developing capabilities to “win decisively in chemical, biological, radiological, and nuclear environments,” compromising its ability to to achieve its important mission. This phenomenon is not limited to DoD. A Congressional Research Service report noted that the Health and Human Services’ Office of the Assistant Secretary for Preparedness and Response’s (HHS/ASPR) Strategic National Stockpile (SNS) also experienced unstable budgets from start to present. 

The second issue is the tendency for biodefense funding to be cut at critical times or to make room for other defense priorities. During the COVID-19 pandemic, one of the deadliest and most significant biological events in modern times, the DoD sought to spend less on chemical and biological defense-related programs. It sought to achieve this through a nearly 15%  drop in research and procurement funding for CBDP – the very program that is meant to help maintain force readiness despite adverse chemical, biological, radiological, and nuclear combat conditions. This cut was justified by former Defense Secretary Esper to purchase hypersonic missiles and other weapons needed to deter or fight Russia and China. The SNS also experienced such cuts during the Obama Administration, resulting in hard decisions for what to stockpile, what items to reduce, and what items to let expire due to heated battles in Congress concerning the rising federal budget and the debt ceiling.

10B + 10B Over 10 – A Funding Vision for U.S. Biodefense

The convergence of increasing biological risks with the willingness of the U.S. government to meet the difficult challenges of these threats head-on provides us with a unique opportunity – an opportunity to properly and stably fund U.S. biodefense programs and initiatives. Biodefense initiatives and programs exist across many government agencies, including the Department of Energy, Department of State, Department of Homeland Security, U.S. Department of Agriculture, Department of Health and Human Services, and Department of Defense. In a recent piece in Arms Control Today, Andy Weber proposed a funding model that focused on HHS and DoD to provide a vision that takes significant strides for addressing biothreats through the purview of these two government agencies. This model, called 10 + 10 Over 10”, includes:

  • $10 billion per year to HHS for biodefense-related programs and initiatives: This level of funding would help support multiple efforts, including but not be limited to: 1) enhancing the ability of the Biomedical Advanced Research and Development Authority (BARDA) to transition medical countermeasures from research through advanced development; 2) supporting efforts to modernize and enhance HHS/ASPR’s SNS initiative, and; 3) helping build the necessary capacity and expertise to enhance FDA’s capabilities for reviewing and ensuring that medical countermeasures are safe and effective.
  • $10 billion per year to DoD for biodefense-related programs and initiatives: This level of funding would also help support multiple efforts, including but not be limited to: 1) providing stable and necessary funding to restore and enhance CBDP’s budget, particularly its medical  component, to increase capabilities to research, develop, and leverage emerging and next-gen technologies for early warning systems, rapid characterization of microbes, rapid-response platforms to develop medical countermeasures; 2) supporting and expanding global efforts to strengthen relationships and reduce biological dangers through the Department’s Biological Threat Reduction Program (BTRP); 3) enhancing the care and meeting the health and wellness needs of our service-members through the infectious disease components of the Defense Health Program; and 4) encouraging and innovating breakthrough technologies for national security through the Defense Advanced Research Projects Agency (DARPA).
  • Maintaining this $10B annual level of funding both for HHS and DoD for 10 years.

Further, this funding approach is also meant to foster a vision of collaboration – one where partnerships between DoD, HHS, and the private sector are the norm. This vision is inspired by the efforts and achievements of Operation Warp Speed (OWS): the moon-shot initiative of public and private stakeholders that took the world from sequence to vaccine in less than a year

HHS and DoD have complementary capabilities that, together, can make great strides towards the capabilities needed for deterring bio attacks and preventing pandemics. For example, defense programs to counter biological threats house special authorities and skilled acquisition personnel that were leveraged in partnership with HHS to accelerate treatments and vaccines for COVID-19. Both departments need to be fully resourced on a strong and consistent basis going forward, in addition to each department’s leaders ensuring that collaboration continues.

Operation Warp Speed showed that when governments offer sufficient funding and expertise, the private sector can swiftly bring incredible advancements in sequencing technologies, synthetic biology, and other innovative technologies to the table, and the U.S. and the globe can overcome even seemingly insurmountable challenges. This is the type of bold funding and collaborative vision necessary to not only overcome the rise of biological threats, but enable all of humanity to thrive in the 21st century.

15 million doses of COVID-19 vaccines ruined

 The first big question the public will ask is whether any of the 15 million doses of Johnson & Johnson’s vaccine that workers ruined in a manufacturing mistake made it to vaccination lines. The New York Times, which broke this story late Wednesday, says that the mistake does not involve any of the vaccines in the supply chain right now. In other words, the mistake was contained at the factory. 

That should be a loud and clear message today; that the safety of vaccines that people are lined up to get is not in question.

All of the doses in the pipeline right now came from Johnson & Johnson’s plant in The Netherlands. The mistake happened at the plant of a subcontractor, Emergent BioSolutions, which is in Baltimore. 

Johnson & Johnson hired Emergent BioSolutions to manufacture the active ingredient. Workers at the facility mistakenly mixed ingredients for the Johnson & Johnson vaccine with those of another manufacturer’s shot. Emergent does contract work for both Johnson & Johnson and Moderna.

The Baltimore Sun says the mixup happened a couple of weeks ago, but until now, word did not leak. Johnson & Johnson issued a statement Wednesday night that doesn’t mention the mistake until the third paragraph. When it does get to the issue, it says:

As with the manufacturing of any complex biologic medication or vaccine, the start-up for a new process includes test runs and quality checks to ensure manufacturing is validated and the end product meets our high-quality standards. This approach includes having dedicated specialists on the ground at the companies that are part of our global manufacturing network to support safety and quality.

This quality control process identified one batch of drug substance that did not meet quality standards at Emergent Biosolutions, a site not yet authorized to manufacture drug substance for our COVID-19 vaccine. This batch was never advanced to the filling and finishing stages of our manufacturing process.

This is an example of the rigorous quality control applied to each batch of drug substance. The issue was identified and addressed with Emergent and shared with the United States Food & Drug Administration (FDA).

Politico explains the backstory:

Emergent was supposed to send its drug substance to Catalent, a New Jersey drug manufacturer, to bottle the vaccine. The FDA approved Catalent’s production role last week, and Emergent had already begun shipping millions of doses to the other firm, people familiar with J&J’s authorization told POLITICO last week. But Catalent cannot release the Emergent doses without the Maryland company’s emergency clearance.

The Johnson & Johnson vaccine is the only one-dose shot approved for use in the United States. Even though this supply interruption is not insignificant, Pfizer and Moderna’s two-shot vaccines are in full production (and Pfizer is even ahead of its production schedule), so it is uncertain right now if any Americans will have their vaccinations delayed. Johnson & Johnson says it expects to meet its goal of producing a billion doses by the end of 2021.

The larger unanswerable question is how will this bad news sit with the already skeptical unvaccinated public?

OSHA issues proposed rule to update hazard communication standard

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) today issued a proposed rule to update the agency’s Hazard Communication Standard (HCS) to align with the seventh revision of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS).

OSHA expects the HCS update will increase worker protections, and reduce the incidence of chemical-related occupational illnesses and injuries by further improving the information on the labels and Safety Data Sheets for hazardous chemicals. Proposed modifications will also address issues since implementation of the 2012 standard, and improve alignment with other federal agencies and Canada.

Individuals may submit comments identified by Docket No. OSHA-2019-0001, electronically at http://www.regulations.gov, which is the Federal e-Rulemaking Portal. Read the Federal Register notice for details. The deadline for submitting comments is April 19, 2021.

OSHA has preliminarily determined that the proposed modifications would enhance the effectiveness of the standard by improving dissemination of hazard information so employees are more appropriately apprised of exposure to chemical hazards in the workplace. 

Established in 1983, the Hazard Communication Standard provides a standardized approach to workplace hazard communications associated with exposure to hazardous chemicals. OSHA updated the standard in 2012 to align with the third revision of the United Nations’ GHS to provide a common and coherent approach to classifying chemicals and communicating hazard information.

908 Devices Awarded Multi-Year $25M Purchase Order to Enable the U.S. Army

Lebanon clean up - Nuclear material found at oil facility

The German company tasked with clearing hazardous material at Beirut port, and around the country, has discovered radioactive material at the Zahrani Oil Installation, which is about 50km south of the port. 

According to Prime Minister Diab the substance found "is a highly pure nuclear substance" and posed a danger. The head of the installation Ziad el-Zein, told local Al-Jadeed TV that Combi Lift inspected the facility and found eight small containers that weigh less that 2 kilograms (4.4 pounds) containing depleted uranium salts. El-Zein added that the material has been stored at the facility since the 1950s, when it was run by the Mediterranean Refinery Company which was active in Lebanon until the late 1980s.

A document from the Zahrani Oil Installation that was posted by local media Friday said that the committee following up on the "chemical material" decided to move it to the laboratories of the Lebanese Atomic Energy Commission. The March 22 document warned that the Lebanese atomic commission will inform the International Atomic Energy Agency that it cannot store the material in Lebanon in accordance with international standards.

This pioneering initiative, entitled Phoenix I, is the first in a series of interconnected projects developed by Drone Major Group, with several regional partners, to deliver, for the first time, commercially viable, scalable and environmentally sustainable drone services across all environments (surface, underwater, air & space), and in all the sectors that are vital for the UK and world economy. The transformational project promises numerous benefits to the City Region, creating new investment and economic growth, employment, skills, education and a cleaner environment. 

LCRCA has played an instrumental convening role working with Drone Major Group to facilitate the active involvement of many of the region’s most vital 
stakeholders in the delivery of the project, including, Peel Ports Group, LogisticsUK, SP Energy Networks, Manufacturing Technology Centre (MTC) 
Liverpool John Lennon Airport, the University of Liverpool and Liverpool John Moores University.  

A roadmap has been created for this unique project which identifies key themes, outlining a clear pathway to develop operational drone capabilities to be delivered in the fields of urban logistics, the environment, security, maritime logistics, port & maritime, and the wider community. All projects within the newly established Phoenix programme, which currently comprises 10 new initiatives addressing these sectors across the UK, will share a common operational model and advanced data analysis to ensure that progress accelerates exponentially.  

This commercially accelerating approach is set to stimulate Liverpool City Region’s inward investment opportunities, while enhancing the region's global recognition as a hub for cutting-edge technological innovation. This is a particularly pivotal time for the City Region, with the Combined Authority’s emerging Climate Action Plan crystallising its decarbonisation agenda, together with the grant of Freeport status for Liverpool City Region announced by the Chancellor in his budget speech on 3 March 2021.  

The Liverpool City Region benefits from some of the country’s most outstanding digital infrastructure, academic knowledge and individual experts who will be integral to realising the potential of autonomous drone systems in the UK, such as the University of Liverpool’s Centre for Autonomous Systems Technology (CAST), Liverpool Institute for Sustainable Coasts and Oceans (LISCO) and Virtual Engineering Centre (VEC), and the drone research group at Liverpool John Moores University.
